How to Challenge a HORRIBLE C&P Exam

A bad C&P exam can literally make or break your VA disability claim, and if your examiner rushed the process, dismissed your symptoms, or issued an inaccurate report, you need to act—fast. If you believe your exam was incomplete, inaccurate, or unfair, you must take action immediately! Here’s a simple 5-step process you can follow: Step #1: Call the VA Hotline – Call 1-800-827-1000 and request a new C&P exam. Report the examiner’s errors, lack of thoroughness, or bias. Stick to the facts only. Step #2: Write a Memorandum for Record (MFR) – Document exactly what happened during your exam—what the examiner asked, what tests were skipped, and how they failed to accurately assess your condition. Upload this to VA.gov as part of your claim file. Step #3: Request Your C&P Exam Report – Ask your accredited VSO to access the exam report in the VBMS system. If the report is inaccurate, challenge it immediately. Step #4: Submit Independent Medical Evidence – If your exam was flawed, submit a private medical opinion, DBQ, or Nexus Letter from a qualified provider to counter the C&P examiner’s findings. Toxic Exposure at Camp Lejeune: From 1953 to 1987, veterans, service members, and their families at Camp Lejeune and MCAS New River were unknowingly exposed to hazardous chemicals in the drinking water, leading to severe health conditions, including various cancers and neurological disorders. VA Presumptive Service Connection: Veterans who served at Camp Lejeune for at least 30 cumulative days during the contamination period and developed one of the VA-recognized presumptive conditions, such as bladder cancer or Parkinson’s disease, are automatically eligible for VA disability benefits without needing to prove direct causation. Family Member Eligibility: In addition to veterans, family members who lived at Camp Lejeune may qualify for VA healthcare benefits if they developed one of 15 covered conditions, including breast cancer, kidney cancer, and miscarriage. They can receive medical care cost reimbursements with proper documentation of residency and diagnosis. Between 1953 and 1987, multiple water treatment plants on Camp Lejeune were contaminated with toxic chemicals, including: Trichloroethylene (TCE) – a degreaser linked to kidney cancer, liver cancer, and neurological disorders Perchloroethylene (PCE) – a dry-cleaning solvent associated with bladder cancer and leukemia Benzene – a carcinogen that can cause leukemia and other blood disorders Vinyl chloride – a hazardous chemical linked to multiple types of cancer These harmful chemicals exceeded safe limits and were present in drinking water for decades. In a recent video message from his desk at VA Central Office, Secretary of Veterans Affairs Doug Collins addressed media concerns that Veterans’ benefits might be targeted for cuts. “I’m the Secretary of VA, and I’m telling you right now, that’s not happening… the reality is, Veterans benefits aren’t getting cut,” Collins said. “In fact, we are actually giving and improving services.” He went on to emphasize that the Veterans Benefits Administration is clearing cases faster than ever and that VA remains mission-focused by doing what it is supposed to do. Now, in his first full week on the job, Collins also addressed concerns about the Department of Government Efficiency (DOGE) and rumors regarding access to Veterans’ personal information. He clarified that DOGE representatives at VA are reviewing contracts to ensure operations remain efficient and that resources are directed toward services for Veterans. “I’m happy to partner with them to find things we need to get rid of so we can put the money where it belongs… back with our Veterans,” he said. Meanwhile the CBO and opposers like to think otherwise Project 2025's VA section, written by former VA Chief of Staff Brooks Tucker, suggested that the new administration "target significant cost savings from revising disability rating awards for future claimants while preserving them fully or partially for existing" recipients. While President Donald Trump distanced himself from Project 2025 during his campaign and Collins said in his hearing that he had not read the document, the administration has, in its first three weeks of office, implemented the document's recommendations on eliminating diversity initiatives, freezing federal funding, and withdrawing from the Paris Climate agreement, among others. Trump has completed one Center for Renewing America recommendation -- signing an executive order that enforces the Hyde Amendment barring the use of federal funds for abortions -- and moved to end protections for transgender individuals, also suggested in the document.
